At Romeo & Schmitt P.C., we have worked with families throughout Rochester and Upstate New York in child support cases and other legal issues related to family law. Child support issues can arise out of a divorce or other broken relationship and can often be difficult for both parties. An experienced attorney can provide the responsible and caring support that you need, while protecting your rights and the rights of your children.
State Guidelines in Child Support
New York child support laws rely on the Child Support Standards Act as a guideline for determining the appropriate amount of support. The Child Support Standards Act (or CSSA) is applied when deciding what percentage of a parent's income should be set aside to provide support for their children.
The statute outlines a set amount of the parent's income that will be used when calculating child support, which is dependent on the number of children involved. This income is not only limited to the parent's wages, but can also include unemployment and disability payments, Social Security benefits and other sources of income.
At our firm, we can help protect your rights in child support disputes by looking at New York child support laws and all other factors that the court will consider. These factors include:
- Income of both parents, including wages and other sources of income
- Residency of the children
- Amount of time the children spend with each parent
- Financial resources of each parent
- Availability of medical and dental insurance
Modification and Enforcement of Existing Orders
When substantial life changes occur, such as a change in employment status, a change in the needs of the child, a remarriage or the birth of another child, you may need to modify your existing child support order. Alternately, if the other parent is not paying child support, or is violating New York child support laws, you may need to enforce the child support order. Our lawyers at Romeo & Schmitt P.C. can help you with all post-decree modifications and enforcements in child support cases.
